🇨🇦 🇪🇺 The text of the draft decision of the CETA Joint Committee on access to ISDS for natural persons or small and medium-sized enterprises is now available. ⚖ The draft decision aims notably to respond to the concerns expressed by the EU Court of Justice (Cour de justice de l'Union européenne) regarding the consistency of ISDS with the right to access to justice. It also seeks to support an inclusive approach to trade and investment. ⏱ It creates an expedited procedure before a single member of the Tribunal to facilitate access to ISDS. The defending party must accept the request of the investor to use the procedure. It is capped at claims not exceeding SDR 40 millions (i.e. roughly USD 50 millions). ✅ It remains to be seen if this will be considered sufficient to protect the right to access to justice. For instance, the standard appeal procedure remains applicable, which may frustrate the benefits of the expedited procedure. 👉 The text of the draft decision is available at https://lnkd.in/dD7hgfzk
